In 2016, Tennessee passed a Ban the Box law that prohibits state employers from asking about a job applicant’s criminal history. Shelby County also has its own Ban the Box law for county employees. Additionally, the EEOC is responsible for enforcing federal laws that prohibit employment discrimination.

While employers can consider a job applicant’s criminal history, they must determine whether that history impacts the job. Further, employers cannot discriminate based on arrest records, as these records do not prove that the applicant committed a crime.
